Essay

The creation and establishment of WUPR (Western Ukrainian People's Republic), the functioning of governmental system, and the lawmaking by the legislative and executive authorities. The purpose of the research- identifying distinguishing features of development, structure and functioning of the WUPR governmental system; on this basis, making recommendations for improving existing governmental bodies of Ukraine in the modern circumstances. Methodology: historically comparative, comparatively juridical, systematically structural, functional, logical, etc. The experience can be well applied at creating governmental bodies of the modern Ukrainian state, attorney-at-law offices, etc. Theoretic findings: WUPR was a democratic and legal nation; law enforcement was the most qualified and professional component of the governmental system; a democratic political structure was established in WUPR, which encompassed both Ukrainian and Jewish political parties and public organizations. The research material can be used in scientific studies; instruction at law schools and other learning institutions; professional development courses for government officials or, lecturing and propagating activities. The application is instructional, scientific, for drafting bills. In this research, on the basis of legislation analysis, archives and monographic material, we comprehensively study the creation, patterns and workings of the WUCB governmental system, both in the time of existent state within the territory of Ukraine (1918-1919), and, later, beyond its territory, in exile (1920-1923). We gave description to the establishment, structure and functioning of the machinery of such governmental creations of Ukrainian nation inside WUPR as Lemkivska, Western Lemkivska, and Gutsulska republics and their relationship with WUPR government. Identified and analysed were over 100 legislation acts of WUPR which regulated the structure, authority and functions of WUPR, and have not been known until recently. Considerable amount of archival material has been introduced into the scientific circulation.
