Special proceedings in civil procedure, order of trials of citizen's competent or partially incapable state recognition cases. Complex scientific analysis of special proceedings as structural component of civil procedure, nature of citizen's competent or partially incapable state recognition cases, formulation of theoretical statements and practical conclusions, directed to substantiation of the structure of a new CPC of Ukraine and improvement of legislation. The author uses historicallegal, comparativelegal, systematic-structural, formal-logical, dogmatic and other common scientific and special research methods. The author substantiates and formulates conceptual approaches concerning the structure of a new CPC of Ukraine, place of special proceedings in civil legal proceedings. The volume and contents of civil competency as an object of court protec-tion, procedural order of hearing and settling of citizen's competent or partially incapable state rec-ognition cases are characterised. The results of t he research can be used for improvement of civil procedural legislation, court practise. The area of application is lawmaking, research activity and education process.
