Goncharenko M. Real rights of immovables

The dissertation is devoted to theoretical and law applications problems which connected with legal regulation and realisation of real right (right in rem, law of estate) of immovable property (immobility, realty). Some peculiarities of real right of immovables are analysed in the context of realization of real rights, including proprietary rights and right of other persons' things (possession, servitude, superficies, emphyteusis, hypothec). The author's carried out complex investigation of real rights of immovables beginning with the Roman private law, civil law of foreign countries and Ukrainian civil law. The analysis of operative Ukrainian legislation, it's law application practice, foreign countries' legislation and scientific literature al lows to draw some theoretical conclusions and concrete proposals on application and improvement of definite laws regulating the realization of real rights of immovables in particular concerning the concept of immovables and necessity of special legal reg ime of legal relation relative to immovable property, concerning types and content of real rights of realty in Ukraine, its social functions.
