Demchenko N. Sal-and-purchase contract for privatisation objects (based on arbitration proceedings in Ukraine).

The author investigates contractual relations, and their legal regulation, in sale-and-purchase of privatisation objects. Analysed were the subject complement, the object, the content of sale-and-purchase contract in reference to privatisation process, as well as were examined the issues of concluding sale-and-purchase contracts for privatisation objects and declaring them invalid. The work determines and substantiates the concept of the sale-and-purchase contract through privatisation process and its peculiarities. A number of scientific and theoretical provisions have been elaborated referring to: financial intermediaries taking part in the sale-and-purchase contract relations in the process of privatisation; the procedure of concluding the sale-and-purchase contract for privatisation objects that are aimed for reaquisition, auctions, or biddings; determination of the grounds for said contract to be declared invalid and application of the consequent procedure. The dissertation has formul ated concrete proposals as to improvement of legal regulation of sale-and-purchase contractual relations in the process of privatisation as well as its practical application.
