Astakhov V. "Juridical regulation of the functioning of the higher establishments of education in the Ukraine based upon non-state forms of property"

The thesis is devoted to the research of the legal essence of higher educational establishments, based upon the non-state property form, which is revealed by the analysis of its legal status and to the problems of legal regulations of the relations attached to their creation and functioning. Definition of Higher institutions of Non-state property forms as well as general features and distinctions from state higher institutions have been formulated. The analysis of subject of law ability of Higher institutions of Non-state property forms has been done. The conception of contract relations of Higher institutions of Non-state property forms for contemporary conditions has been suggested as well as the essence of legal agreement on provision of educational services has been thrown open. Responsibilities of both sides of an agreement have been exposed. Suggestions given as for perfection of the valid Ukrainian legislation in the sphere if legal relations, connected with the creation and functioning of High er institutions of Non-state property forms have been formulated.
