Essay

Thesis is devoted to a new methodology, theoretical and practical grounds of modern Ukrainian state and law. Stated aim is being realized by the way of comprehension of the phenomenon of freedom as fundamental, semantic and principle of liberal and democratic legal state. The nature of legitimistic and contractual theory of state and law is studied. The essence of deliberative democracy, new "power's division", new kind of "community" and new aspect of civil society is found out. Cosmopolitical character of democratic citizenship as the main law institution of EC is revealed. The contents of the main rights and freedoms of Ukrainian citizen in the context of European Soviet and EC demands is analyzed. Principles, forms and methods of Ukrainian state institutions' activity, dealing with the security of the main person's and citizen's rights and freedoms are shown. Problems of lawkeeping activity and international cooperation optimization in the sphere of person's rights and freedoms protection are studied.
