Vinnyk O. Theoretical Aspects of Business Corporation/Partnership Public and Private Interests Legal Guarantee.

The dissertation contains complex analysis of theoretical and practical issues connected with legal guarantee of private and public interests realization in business corporations and partnerships. Classification of private and public interests is conducted, general grounds of the balanced involvement in the process of business activity legal regulation is defined, the reasons of arising interests conflict in business sphere and corporate relationships in particular are systematized, separation of interests conflict concept from related concept of contradiction, tort and dispute (economic, civil, etc.) is made. Concept of corporate relations as a kind of economic relations that arise in the process of forming, functioning and stopping business corporations/partnerships and that are characterized by a complex composition of the participants (direct and indirect) - transmitters of various types of private and public interests is suggested. Valid legal mechanizms of ensuring consideration of corporate relations participants private and public interests are systematized and new legal measures of ensuring these interests balance with the aim of optimizing business partnerships/corporations activity, preventing corporate conflicts and improving the order of their settlement are suggested. New direction of Economic Legal science - Corporate Conflictology is substantiated.
