Fesenko Y. Crimes Against Health of Population and the System of Measures Ensuring its Protection

On the basis of research into general theoretical issues of criminal law (new concept with regard to the object of crime, rectified methodology of differentiating between adjacent corpus delicti of crimes, etc.), the thesis deals with the issues of criminal legal characteristics of crimes in the sphere of turnover of narcotic means, psychotropic substances, analogues thereof, or precursors and other criminal acts against health of population and the system of measures ensuring its protection. Herewith the development and state of the legislation in this field have been analyzed as well as the contemporary doctrine of its interpretation and practice of application. The research resulted in disclosing controversial or imprecise provisions and also gaps in the legislation in force. Ways of eliminating these shortcomings are proposed - amendments of the text of dispositions and sanctions of about thirty Articles of the Criminal Code of Ukraine as well as additional three new Articles.
