Belyanevych O. Theoretical problems of business contract law.

The dissertation contains complex analysis of theoretical problems of business contract law as one of the basic institutions of Ukrainian business law, the prerequisites of its formation and development, structural peculiarities and composition. It defines the essence of a contact as a universal instrument of self-regulation of public relations and its functions in the mechanism of legal regulation of business relations. The author has researched the system of sources (social regulators) of business contract law which is formed by legal acts, business customs, court practice, formulary law, and which has moral standards as its axiological grounds. The author has analysed the essence of legal order in business contractual relations and the legal means that secure such legal order: construction of invalidity of business contracts, organizational contracts, contracts in the sphere of state economic activity, and court interpretation of contracts.
