Lubska M. Muslim Law: Philosophical and Religious Phenomena.

In thesis have been made a complete analyses of the Muslim Law as the phenomena of the religious and philosophy. It gave an opportunity to determine and consider this Law as a system of combined internal adjusts, links, social means of law and religion which made a stability and morality regulative influence on social relations and behavior of people by means of islamization of legal practice. It has been consider that the origin of Arabic and Islam philosophy as a rational thought has been condition on ideology movement in theology and fikh but also with a human freedom, responsibility for their actions, and predestination all of the questions as to God interference. It also been based on examined philosophically- rationalist and mystic way of fikh and sharia. Usage of spiritually - legal methods by early religious-legal schools been made with help of islamization rational ways of the solution by means of Koran and sunna. It brought to religious legalization norms of Muslim law based on rational logical methods. Also been analyzed distinguished the document of maliky mazhab "Muwatta" by Malik ibn Anas. In dissertation been consider philosophical and religious sense in the context of modern civilization process, the aspects of which was sequence of mazhab or it complete rejection.
