Essay

The dissertation is devoted to the research of local government constitutional-and-legal status as a fundamental institute of civil society. A concept and structure of civil society, the constitutional basis of its institute functioning is comprehensively considered. The basic theories of self-government were analysed, the definition of local government as one of main forms of democracy, and the constitutional method of the government limitation were proposed by the author. Dependence of local government development on the population civil and political activity was proved. The detailed investigation of mutual relations between the local government and the state, the civil organizations, the mass media, the other civil society institutes was carried out, the propositions about their legal status improvement were formulated. There is a number of concrete propositions in dissertation about the solution of such problems as: the forming of local government organs; the legal regulations of control and supervision activity in local government sphere; the conflict between the subject of local government; the improvements of legal regulation of their (subjects of local government). Its role in stable constitutional order provision and the constitutionalism development in Ukraine was defined. The conceptual basis and directions of local government reformation and its legal ground improvement were formulated.
