Milash V. Commercial contract under economic law: theoretical problems of its establishment and development.

The theoretical generalization and the new settlement of the scientific problems consisting in determination of the economic contract law directions of the development under present day conditions and also problems of the legal ensuring of the commercial character economic-contract relations have been accomplished at the dissertation research. The essence of the economic contract with the help of act theory has been analyzed. The necessity of the separate contracts systematization as the separate trends of the economic law modernization has been given grounds and the author's definitions of type, kind and variety of the economic contracts have been proposed. The main system formed factors which bring about further establishment and development of the commercial contract as one of the most widespread kind of the economic production contracts of the contract type have been determined and investigated. As the result of the carried out research functional purpose of the commercial contract, its place in the system of the economic contracts and its significance at the mechanism of the economic-legal market relations regulations have been determined. The economic legal conceptions (constructions) have been worked out and the existing ones have been improved. among which such as: "commodityability", "economic operations", "economic legal personality" and "procedure of the economic contract conclusion"; author's opinion at the problem of alignment of the concepts such as "effective" and "in force" economic contract has been proposed.
