Essay

The thesis contains complex analysis of theoretical and practical problems of reforming the current bankruptcy legislation of Ukraine. The research work determines a pro-creditor model of insolvency legislation as the most efficient from the economic point of view and reveals social possibilities for the implementation of the model into the legal system of Ukraine. The methodological basis for the research was the fundamentals of Law and Economics and philosophy of history. The author researched the system characteristics of insolvency law as theoretical basis for reforming the current bankruptcy legislation of Ukraine. Optimal legal and organization features of the selected pro-creditor model of insolvency legislation were determined and analyzed, including the most expedient mode of regulating the cross-border insolvency in the domestic bankruptcy legislation.
