Khryapinskiy P. The encouraging norm in the criminal legislation of Ukraine: theoretical, lawmaking and practical problems.

This dissertation is the first criminal legal research of theoretical, law-making and practical problems of encouraging norms in the criminal legislation of Ukraine. The theoretical generalization and new decision of scientific problem, which appears in the number of conceptual theoretical and practical problems in relation to a place and role of encouraging norms in a criminal legislation, social conditionality of their introduction, development of new conception of law-making of encouraging norms, is resulted in dissertation. Encouraging norms are examined as the unique functional institute of criminal legislation, that is able to settle a criminal conflict, using a legal method. The author offered the foundation of criminal legal encouragement and grounded the perfections of present norms and establishments of new encouraging norms in the criminal legislation of Ukraine.
