Essay

Dissertation is devoted to analysis of the problems of securing mechanism of the right to work realization. The work defines the notion, objectives and features of constitutional right to work, its significance and designation in present situation, principles, forms and methods of realization, problems of organizational-legal securing of certain categories of citizens' job placement. The right to work occupies a special place among social-economical rights of a person. It is stipulated by essence of a person and represents her natural need to work. Significance of work in the process of development of a person as a part and society as whole lays not only in creation of material and spiritual values, that are designed to satisfy people's needs, but also in encouragement of workers' development. Effectiveness of legal regulation of the right to work is one of the features of social state, as far as creation of real possibility to gain a job according to person's profession and abilities plays a role of great importance in guaranteeing appropriate standard of living and free development of a person. To fulfill of these objectives a state should maintain a policy that favors: citizens' employment by the means of preservation of existing and creation of new jobsites at enterprises, institutions and organizations of all form of ownership; labour force training, of such professional structure and level of proficiency that will satisfy the needs of labour market; support of independent employment of population, development of entrepreneurship; improvement of labour force qualification, development of professional education system, satisfaction of able-bodied persons' needs in professional education and training considering age of a person and market requirements; strengthening motivation for legal productive employment; coordination and control over employment agents' activity; support of persons, who are not able to compete in labour market on equal conditions; social support of registered unemployed in order to return them to productive employment; protection of national labour market; assurance of social security of citizens of Ukraine, who work abroad; development of collective-contractual support system of full time, productive and freely chosen employment.
