Essay

The thesis deals with the formation of a holistic theory of consolidation, development and effectiveness of referendum democracy in Ukraine as a theoretical and methodological foundation for further improvement of the referendum legal doctrine. This will allow optimizing the law-making and enforcement activities of the referendum process entities in the current stage of national state-making and law-making. The paper substantiates the essence and meaning of the “referendum democracy” category and suggests taking it to mean an independent type of a constitutional law regime represented by the system of the most favorable conditions and means, established by the Constitution and laws of Ukraine, for direct implementation of people’s sovereignty in the form of initiating, organizing and holding referendums as well as implementing their decisions. Specific features of the referendum democracy research methodology are defined; basic principles of this kind of democracy are identified and systematized; a provision on importance of interaction between the type of people’s power under study with other types established by the Constitution and laws of Ukraine is formulated.
