Klymenko O. Constitutional and Legal Regulation of Relations in the Sphere of Realization of the Right for Freedom of Religion in Ukraine

The thesis is dedicated to the research of theoretical and practical issues of state interference into the sphere of constitutional human rights and freedoms on the example of the private property objects expropriation due to public necessity based on effective balance between the owner's public and private interests. The theoretical and historical aspects, the international methods, the foreign experience, the current tendencies in the development of the institute of the private property objects expropriation due to public necessity are highlighted. The consitutional nature, the new tendencies in the institute development, the system of the constitutional-legal regulation principles, which are the features, the indicators and the instruments to attain the balance between the public and the private interests are justified. The issues and the ways to improve the national legislation are researched.
