Essay

Work is studying the constitutional and legal foundations of the system of state power in Ukraine. It proposes the definition of a system of government as a subject of research of modern constitutional law science, gives a summary of theoretical and methodological approaches in its analysis, and also in the research of specific traits of constitutional and legal regulation of the state power in Ukraine organization and functioning. The dissertation proposes an analysis of general and specific factors of constitutional and legal impact on the formation of a democratic system of government in the aspect of practical implementation of the objectives, enshrined in the Constitution of Ukraine, as to its development as a democratic and social state, the state of law, and the civil society. It investigates the constitutional and legal foundations of the democratic development of the state authorities, identifies the urgent problems of political participation in the functioning of democratic government. With the constitutional and legal positions the author investigates fundamentals, principles, values and guarantees for the development of state power in Ukraine. The specific regulatory interaction between political and managerial dimensions of the system of government is analyzed. The author demonstrates the main trends in the development of legislative, executive and judicial power in Ukraine in the context of constitutional changes of 2004-2012. The problem of harmonizing and streamlining regulatory interactions of the legislative process, administrative management, judicial reform is argued and worked out. The author pays particular attention to the constitutional provision of law enforcement and control of public authorities as an important condition for effective development of the government, the rights and freedoms of citizens, supremacy of the constitution, separation of powers.
