Essay

The dissertation gives a theoretical generalization and presents a new solution of scientific problems of determining the legal basis for the development of the system of a modern state functions. The theoretical-and-methodological approaches in the theory of state and law which regard the characteristics of the modern state functions are identified and summarized. The system the state functions is characterized as a set of interrelated dynamic characteristics of the state, which are seen as objectively necessary, the legally defined, filled with socially relevant content, main activities of the state, in which its goals and objectives are detailed, and which display its intrinsic characteristics. The dissertation performs a historical reconstruction of the evolution of the system of state functions in Ukraine. The general characteristic of legal support of the state functions at the present stage of Ukraine's development of as a democratic state, state of law and social state are given. The main areas of improvement the constitutional base of the state functions in the process of constitutional modernization and development of the national legislation of Ukraine are shown. The directions of state legal politics to insure the state functions of in the aspect of its interaction with civil society are defined. The author proves the role of the theory of constitutional state in changing the overall paradigm of legal support the system of functioning in the modern democratic form of government.
