Sevostyanova I. The theoretic-methodological foundations of the functioning judiciary mechanisms

The object of study - the mechanisms of the judiciary in the system of public administration. Methods of research - a systematic approach, methods of analysis and synthesis, system-information, historical, comparative legal, modeling. The practical significance of these results is that the recommendations made can be used in the management of public-sector and the legislative process for the development of organizational principles of the judiciary in the theory of public administration, further implementation in Ukraine conceptual provisions of the judicial reform, the formation of the development strategy of the judiciary at the state level state programs of strategic direction, formed the basis of development of mechanisms to improve the performance of the judiciary, as well as activities of public authorities. Scientific novelty of the research lies in the fact that for the first time proved the theoretical and methodological bases of functioning mechanisms of the judiciary, a new conceptual model of functional orientation of organizational actions to ensure the judicial system in the context of the tasks of public administration, proposed and justified, a mechanism for increasing the quality of justice through measures that contain evaluation of positive and negative speaker defined. Theoretical approaches to the formulation of public administration policy by applying the principles of complexity and system in the definition of strategic goals, directions and guidelines of public administration in the field of organizational support of the judiciary, the methodological approaches to the determination of the formation of information resources in the judiciary, the methodological approaches to the analysis and evaluation of the Court by supplementing it qualitatively new state mechanisms improved. Methodological foundations of the organization and functioning of the judiciary in the process of integrating and systematic functioning of the public administration in general, the rationale for the use of a systematic approach in the study of the functioning of the judicial system in the mechanism of governance of countries with different legal systems of modern typology, categories of the theory of public administration in the field of operation mechanism of the judiciary, according to which in the scientific revolution introduced copyrights definitions concepts of "legal regulation of organizational support of the judiciary in the area of governance," "form of public administration in the area of the judicial system"; institutional mechanisms for the implementation of indicators to measure performance in the work of the judicial system have been further developed.
