Essay

The dissertation focuses on the theory and practice of evidence in civil proceedings in Ukraine and as a result the concept of civil evidence procedure has been stated in the research. The legal nature of proof and evidence have been clarified. The author has defined the essence of the system and the principles of proof, the proof subjects have been classified, new methodological approaches to the study of evidence-based presumptions and fictions and its definitions have been offered. The theory of evidence stages (phases) have been formulated and based on national lawmaking experiences.
