Essay

The thesis is dedicated to theoretic analysis of U.S. Criminal Law doctrine, its genesis, basic constructive elements, issues of their interaction and stipulation, practical value of criminal law doctrinal sources. The Criminal Law Doctrine is being considered as a reflection of ideas, stipulated by a set of legal, philosophic and political factors, in respect to their dynamics in the process of genesis. A lot is attended to the genesis of American Criminal Law Doctrine, especially to its historical, political and sociocultural grounds, its periodization is being proposed. Particular interest refers to a research of constructive elements of the doctrine: legal science, fundamental grounds of Criminal Law, and concepts of Common Law – the product of judicial practice. The mechanisms of their interaction is being reviewed, the concept of American Criminal Law is substantiated through the prism of the legal doctrine. The proximate prospects of U.S. Criminal Law Doctrine are being defined, some ideas for future development of Ukrainian Criminal Law are proposed.
