Essay

The thesis deals with a comprehensive theory of constitutional and legal bases of the development and functionality of civil society in Ukraine, its government relations in the sphere of protection of constitutional human rights and freedoms, the establishment of the rule of law and democracy; the proposals for the improvement of provisions of the Constitution and laws of Ukraine about civil society partnership and its institutions with Ukraine have been put forward. Civil society is a historically formed, an integral system of independent and accomplished social relations and independent subjects within the government, which, basing on the principles of equal partnership with the state, legally ensure the realization and protection of constitutional human rights and freedoms and lawful interests of people, the establishment of democracy and the rule of law, as well as the participation in the state affairs administration, influence the constitutional and law-making and law-enforcement activity. Its essential features are self-governing, voluntary, self-sufficiency, pluralism, openness, etc. In this paper we have described the content and the features of constitutional and legal bases of civil society; the thesis contains theoretical generalization; it systematizes relevant studies by native and foreign constitutional lawyers about the essential features of constitutional status of civil society, its structural and functional bases. The methodology for the research perspectives of theoretical and practical issues of the development and functionality of civil society in Ukraine has been considered; the positive experience of explored category standardization in the Ukrainian and foreign constitutional legislation, first of all, in the legislation of E.U. member states, has been analyzed.
