Nykytchenko N. Legal regulation of public control in the sphere of economic activity

Research object: public relations, related to realization of state control in the field of economic activity. Research purpose: development of conceptual positions of theoretical and научно-практического character and development on their basis of suggestions on perfection of the legal adjusting of state control in the field of economic activity, which are directed on development of the legal state and socially-oriented economy. Research methods: dialectical, synergetics, legalistically-logical, historical, comparatively-legal, analytical-synthetic, system-structural, logical-legal. Theoretical and practical value: the methodological base of economic-legal researches is extended, including in going near cognition of essence of state control in the field of economic activity. Suggestions, formulated in dissertation, got introduction in practical activity: Commercial and industrial chamber of Ukraine; Executive committee of Chuguev city advice of the Kharkov area; communal enterprise of "Chuguevvoda", State financial inspection of Ukraine; the project of law geared-up "On making alteration and additions in the Economic code of Ukraine in relation to state control in the field of economic activity", directed Institute of economic-legal researches of the National Academy of Sciences of Ukraine in Supreme Rada Ukraine in Committed on questions of economic policy. Scientific novelty: a place and role of state control is certain, the legal argumentation of application is given to the relations of state control in the field of management of conception of public services. Principles of state control are improved in the field of economic activity, economic-legal nature is exposed and his concept is formulated. Suggestions are grounded in relation to plenary powers and responsibility of organs of state control. Legal position of management subjects is analyzed in relationships with the organs of state control. A right is investigational of protection and methods of protection right interests of participants of relations of state control in the field of economic activity, grounded suggestion in relation to the ways of his perfection. Factors are analyzed, negatively influencing on protection of interests states in control legal relationships with the subjects of management. Expansion of legislative guarantees of rights for management subjects is grounded in relationships with the organs of state control. Foreign experience of adjusting of state control is investigational in the field of economic activity. Basic directions of perfection of the legal adjusting of state control are grounded in the field of economic activity in Ukraine. Sphere of the use: subjects of initiation of bill; organs of state control; subjects of organizationally-economic plenary powers for the use in the process of realization of the jurisdiction given by him; institutions of higher education.
