Ulyanova G. Methodological problems of civil-legal protection of intellectual property rights against plagiarism.

The dissertation is the first Ukrainian special complex research of methodological problems of civil legal protection of intellectual property against plagiarism. The author investigates general approaches to determination of the notion of plagiarism, discovers its essence as a social, ethical, and legal category and determines the essential features of plagiarism. The researcher discovers the correlation of such categories as misappropriation of authorship, coercion to co-authorship, coercion to authorship refusal, imputation of authorship. The aim and general principles of legal policy in the area of intellectual property protection against plagiarism are determined. There are defined the peculiarities of perpetration of plagiarism in various spheres of intellectual and creative activity. The notion and means of civil legal protection of intellectual property rights in judicial form are determined. There are defined general principles of protection of intellectual property rights against plagiarism extrajudicially. There are formulated propositions as to the improvement of legal regulation in the field of protection of intellectual property rights.
