Bulat Y. Problems of improvement the legal protection of the results of intellectual activity in the process of Ukraine's integration into the European Research Area

In this dissertation, the author proposes solution for problem of improvement of legal protection of intellectual activity results when Ukraine is in process of integration into European Research Area, and methods for providing legal protection of intellectual activity results in scientific and technological spheres, which impact on innovative development. At the present stage, which is characterized by Eurointegration vector of development and entry of Ukraine into European Research Area, it is proposed to improve policy of legal protection of intellectual activity results in scientific and technological spheres, which directly impact on the innovative way of development of the country. The conducted analysis shows that Ukraine has a status of “emerging innovator” in the European Union rating for innovative development. Generally, total innovation index for Ukraine is twice lower than the average index of the other European countries. In this context, special attention should be focused on necessity to improve intellectual property legal protection, which is a component of the innovation system in the whole. There is no doubt that the key tendency of the legal protection in this sphere should be the ensured realization of lawful rights and interests of the people. With the view of improvement of legal protection of scientific discoveries, it is proposed to reveal their protectable signs, which are subject to be patented, in practical part of the record. The author further proposes to define a method, which can organize proper material and non-material object management with certain technical and commercial results, and which is innovative and useful and satisfies needs of society, as a “business-method”. Improvement of mechanism for legal protection of rationalization proposals and business-methods also proposed.
