Essay

The dissertation is devoted for the solution of the complex legal problem concerning the study of the development of legislation in the field of intellectual property in Ukraine in the 19th century- 21st century within the limits of common methodological approaches to the formation of the Institute of Intellectual Property Rights. The author analyzes and systematizes the level of theoretical developments and historical knowledge from each historical period of development of the sphere of intellectual property rights in Ukraine in accordance with a certain historical model. It was studied modern theoretical and methodological approaches to the definition of the institution of civil law, intellectual property rights. The research analyzes a comprehensive source base for legislation. A wide range of archival documents is involved in the work. The formation of legislation in the field of intellectual property on Ukrainian lands in the framework of a single legal institute covering copyright, patent law, institute of individualization facilities and other objects of intellectual property is described in detail. The various stages of the formation of legislation are shown, each of which has its own peculiarities. Historical models of intellectual property rights in Ukraine are presented in the context of the formation of the legal system in general and taking into account the territorial economic, socio-cultural, political features of Ukrainian lands, which in different historical periods were under the control of foreign states. The attention is focused on the fact that the Austro-Hungarian and Russian imperial legislation, in most modern territories, developed in the light of European legal experience, that is why Ukrainian lands were not outside the world of intellectual property rights protection trends. It is determined that the process of formation of legislation was carried out in parallel with minor differences.
