Essay

The dissertation is devoted to the analysis of theoretical and methodological foundations of law-formation. The history of the genesis of ideas about law-formation was analyzed in the scientific work. This allowed to periodise its development in the three stages: 1) the domination of philosophical understanding of law-formation (XI–IX centuries – the end of the XVIII century AD); 2) the domination of historical and sociological understanding of law- formation (the beginning of the XIX century – the beginning of the XX century.); 3) the domination of scientific legal understanding of law- formation (the middle of the XX century – continues to this day). The state of scientific cognition of law-formation is characterized and summarized as a set of views of thinkers, philosophers, statesmen and lawyers.
