Bignyak O. Corporate rights civil protection in Ukraine.

The dissertation is the first in civil juridical science in civil legal research on corporate rights protection issues in Ukraine with the use of a conceptual approach. The dissertation formulated the concept of civil legal protection of corporate rights as a concept, as an element of the mechanism of legal regulation, as a legal institute, as a construct. The concept and features of corporations are studied. The features of creation and functioning of corporate entities (quasi-corporations) in Ukraine are revealed. The concept of forms, methods and means of corporate rights protection is considered. The peculiarities of protection of the state corporate rights, corporate rights of joint stock companies’ shareholders are studied. Future development of legal regulation of corporate rights protection at the present stage of Ukrainian development are outlined. The legal nature has been characterized and the classification of forms of corporate rights protection has been proposed, material and legal methods of corporate rights protection, legal nature and types of corporate disputes have been studied. The scientifically substantiated proposals on improvement of the current Ukrainian legislation concerning the legal regulation of the corporate rights protection are formulated.
