The dissertation provides a systematic historical legal analysis of the legislative framework for formation and development of criminal-executive system of Ukraine during 1990–2005. Author investigated preconditions of reforming the correctional labor system of the Ukrainian SSR, historical aspects of the European legal tradition of the penitentiary system functioning. Conceptual bases of formation of a new strategy of reforming the penitentiary system of our state are described. Issues of legislative support for the reform of the penitentiary system of Ukraine in the context of the measures of Ukrainian state in connection with the accession to the Council of Europe are analyzed. The work carried out comparative analysis of the criminal-executive legislation of Ukraine and other states of various law systems. The domestic experience of formation of legislative bases of formation and development of penitentiary system after 2005 is generalized and prospects of their improvement in modern Ukraine are outlined.
