Essay

The thesis based on an interdisciplinary approach, comprehensively analyzes policy and law as two important social regulators that have a common aim – the effective development of society. The study of the interaction of policy and law involves the works of Ukrainian and Polish scholars of two transformational periods – the late XIX – early XX centuries and the end of XX – early XXI centuries. The scientific ideas of modern Ukrainian and Polish scientists on social transformation are systematized. Based on the functional-teleological approach, the concepts of “policy”, “law” and “interaction of policy and law” are defined. Consideration of the practical level of interaction between policy and law is carried out on the example of public policy and public law. The interaction of political decisions and legal norms in the process of regulating issues related to the form of government, parliamentary coalition and electoral system is analyzed. Based on a comparison of individual situations that occurred in both Ukraine and the Republic of Poland, quantitative and qualitative characteristics of political and legal phenomena and processes are provided. Causal models of interaction between policy and law in Ukraine and the Republic of Poland have been created. The conceptual scheme of proper interaction of policy and law is substantiated, which is designed to minimize the selfish (particular, corporate) aspirations of certain actors and indicate ways to ensure maximum benefit for society as a whole. The immanent elements of this socially useful model of the interaction of policy and law are the scientific basis, value component, information and communication parts, political and legal responsibility.
