Essay

The dissertation is devoted to the complex and thorough analysis of problems of the theory and practice in the field of rule-making of subjects of the labor law. The content of the concept of «rule-making in the field of labor law» and its meaning are clarified in the work. The principles and functions of such rule-making are defined, and also the system of subjects of rule-making in the field of work is outlined. The centralized rule-making in the sphere of labor and normative agreements on social and economic issues at the national level are comprehensively characterized. The author pays special attention to the study of local rule-making in the field of labor. Especially, the author outlines its essence, stages of its origin and evolution are clarified, and the characteristic features of certain local regulations in the field of labor. In the dissertation the author defines the requirements for the rule-making process of the subjects of labor law and highlights its stages. The definition of the concept of «rule-making technique in the field of labor» is given and its structure is outlined. Besides, the author characterizes some forms of response to the adoption of regulations that do not comply with applicable labor legislation. An important aspect of the dissertation became the study of the current state of rule-making of labor law, its problems, gaps and the main factors influencing its effectiveness. The author offers specific proposals to increase the efficiency of rule- making activities of labor law entities.
