Essay

The thesis is devoted to providing a theoretical generalisation and a new solution to the scientific problem – the determination of the essence, content, and disclosure of the peculiarities of the administrative-legal status of the territorial offices of the State Bureau of Investigation, which formed the basis of the development of the corresponding concept, as well as proposals and recommendations for the improvement of administrative legislation in this area. It has been summarised that the establishment of the State Bureau of Investigation of Ukraine as an independent law enforcement body in Ukraine was preceded by a series of historical events that led to the realisation of the need for its creation. At the same time, despite the fact that, over the years of its existence, the powers of the SBI have been significantly expanded, there are still a number of problems in its activity that need to be solved. It has been established that under the administrative-legal regulation of the activities of the territorial offices of the State Bureau of Investigation, it is most appropriate to understand the regulatory and regulating influence of the law on social relations, which arise in the process of its activities, carried out with the help of the norms of the administrative branch of law. It has been established that in the system of legal bases for the activity of the territorial offices of the State Bureau of Investigation, the key place belongs to the norms of the administrative branch of law, which is quite logical from the point of view of the legal nature of the SBI, which is a state authority that implements the law enforcement function of the state. A number of arguments have been presented to support this statement. It has been substantiated that the content of the activity of the territorial offices of the State Bureau of Investigation as a subject of administrative and legal relations is revealed in their actions in the following directions: 1) detection, termination, and disclosure of criminal offences that are within the competence of the territorial offices of the State Bureau of Investigation; 2) elimination of negative consequences from the commission of criminal offences; 3) creation of organisational-management, information-analytical, and other conditions for the functioning of territorial administrations in particular and the State Bureau of Investigations in general. It has been established that the peculiarities of the activity of the territorial offices of the State Bureau of Investigation as a subject of administrative-legal relations are as follows: firstly, the special subject of the emergence of these legal relations, which causes the presence of different directions of activity of the relevant subjects; secondly, the special administrative-legal status of the territorial offices of the SBI, the competence and powers of which are limited to a certain administrative-territorial unit of Ukraine; thirdly, the territorial bodies of the SBI are engaged in the prevention, termination and investigation of criminal cases in the territory of their service; fourthly, can develop and implement strategies that meet the specific needs and characteristics of their service area; fifthly, the specifics of the activity of territorial departments of the SBI are determined by the socio-economic and political development of a certain territory, as well as the criminogenic situation in it, etc. Attention has been drawn to the fact that the current legislation does not distinguish between the tasks of the State Bureau of Investigation as a law enforcement body and the tasks of territorial administrations as elements included in its organisational structure. Therefore, such tasks are based on the fact that territorial administrations are the main subjects of the implementation of the general tasks of the DBR, but only in those territories assigned to them. Thus, the tasks of the territorial departments of the SBI are: prevention, detection, termination, disclosure, and investigation of criminal offences assigned to the competence of the SBI that are committed within the administrative-territorial units to which the relevant department extends its activities. Such tasks are specified in relation to the implementation of the main areas of activity, in particular: operative and investigative, investigative, organisational and managerial, etc.
