Essay

In the dissertation, based on a comprehensive scientific analysis of doctrines by domestic and foreign scholars in the fields of criminology, criminal law, national legislation, international legal documents, and law enforcement practices under martial law, an attempt is made to address an important scientific problem. This problem involves developing measures to prevent and counter corruption in the judicial bodies of Ukraine, while identifying solutions to a number of related fundamental and applied issues of corruption-related crime in Ukraine. Such a comprehensive approach has made it possible to outline theoretical and practical measures for preventing and countering corruption in the judicial bodies of Ukraine. This is achieved through the analysis of scientific and normative legal approaches to defining corruption in judicial bodies and its characteristics, the genesis of the formation and development of anti-corruption legislation in Ukraine, and the disclosure of the state and trends of corruption. The study identifies determinants that contribute to the commission of corrupt criminal offenses, provides a characterization of the offender, and outlines organizational and legal measures of support. These measures form the basis for developing a system to prevent and counter corruption in the judicial bodies of Ukraine at various criminological levels, taking into account global experience, international cooperation, and foreign practices. Drafts of the National Program for Preventing and Counteracting Corruption in the Judicial Bodies for 2026–2030 are proposed, which determines the vectors of effectiveness of such criminological activities taking into account security anti-corruption indicators: effective scores in the Corruption Perception Index; the number of criminal proceedings initiated on the fact of committing corruption criminal offenses in judicial bodies, which were considered with a verdict; the state of citizens' trust in the justice system and ensuring the rule of law in society; a transparent mechanism for filling vacant positions in the judicial bodies of Ukraine; discipline and the state of compliance with judicial ethics; the Action Plan for Preventing and Counteracting Corruption in the Judicial Bodies of Ukraine for the period until 2030, aimed at neutralizing corruption in the courts and containing legal, departmental, procedural, institutional, and organizational blocks of measures. The recommendations are formulated to strengthen special criminological measures to prevent corruption in judicial bodies by adopting a law on the protection of whistleblowers' rights in all spheres of public life, which will provide for a broad definition of persons who will be protected and guaranteed anonymity; introducing a procedure for real control over compliance by persons who have ceased judicial activity with restrictions for a certain period on employment and the conclusion of transactions in the field of entrepreneurial activity with legal entities under private law or individual entrepreneurs; approving uniform criteria and standards of integrity for checking employees of all law enforcement agencies and the court; monitoring of judicial bodies; monitoring the implementation of state anti-corruption measures through a special interactive information system. The ways are identified for organizing international cooperation between law enforcement agencies of Ukraine and foreign partners on the facts of corruption by judges through joint investigative (search) actions; international search; extradition; mutual informing Interpol about the discovery of new information about the wanted person. Such cooperation will have a positive impact on criminological activities and minimize the risks of committing corruption-related criminal offenses not only in judicial bodies.
