The thesis deals with improvement of the theoretical provisions of criminal law in terms of responsibility for the appropriation, waste of property or possession of it by abuse of official position and the development of proposals for the improvement of legislation and the corresponding enforcement practice.In particular, the social determinants of criminal responsibility for the appropriation, embezzlement or taking over of someone else's property by abusing an official's official position have been clarified; the genesis of the criminal law norms on criminal liability for appropriation, embezzlement or possession of someone else's property by abusing an official's official position is traced; norms of similarities and differences in the legislation of Ukraine and foreign countries regarding responsibility for appropriation, embezzlement or taking possession of someone else's property by abuse of official position by an official have been established, proposals for their harmonization have been provided; the content of objective and subjective signs of appropriation, waste of property or taking possession of it by abuse of official position is described; the signs of distinguishing appropriation, embezzlement or possession of someone else's property by abuse of his official position by an official from related crimes and criminal misdemeanors have been established; the qualification of misappropriation, embezzlement or possession of someone else's property by abusing an official's official position is described; proposals were developed to improve the legislation on property protection in Ukraine and the corresponding enforcement practice.
