Essay

In the dissertation, based on the analysis of scientific sources, criminal procedural legislation, and materials from investigative and judicial practice, a comprehensive forensic study of the pre-trial investigation of criminal offenses in the budgetary sphere is conducted. The work argues for proposals to solve a number of praxeological problems that arise during the budgetary period and key financial-economic operations related to state or local budget funds under conditions of actual war and criminal proceedings during martial law. A comprehensive forensic methodology for investigating criminal offenses in the budgetary sphere is developed, based on the concept and classification of such criminal offenses and their forensic characteristics. The algorithm of actions for detecting criminal offenses in the budgetary sphere is defined; the circumstances subject to proof during the investigation are systematized; typical investigative situations and ways to resolve them are provided; the main directions of interaction between pre-trial investigative bodies and other subjects during the investigation of such criminal offenses are outlined. Based on the forensic characteristics, a procedural algorithm for collecting evidence in this category of criminal proceedings is proposed. Particular attention is paid to the legal regulation of the budgetary process and the specifics of conducting criminal proceedings under martial law, as well as scientific and practical recommendations aimed at investigating criminal offenses committed during public procurement. The specifics of the legal regulation and procedure for temporary access to items and documents during the investigation of criminal offenses in the budgetary sphere are clarified. The subject of such access includes contractual, design-technical, estimate, production, and other financial-economic (budgetary) documentation: financial reporting documents, civil law contracts, and documents reflecting the results of internal and external audits. A systemic-functional approach is outlined for involving specialists (accountants, auditors, inspectors, economists, etc.) in investigative (search) actions during the investigation of criminal offenses in the budgetary sphere. This includes obtaining necessary consultations and utilizing specialized knowledge in various forms (obtaining written explanations from specialists, collecting samples for comparative analysis, advisory assistance from specialists, initiating audits and inspections). These methods serve as important and necessary means for searching, detecting, recording, and seizing objects of forensic examinations. They also provide the opportunity to pose expert questions, determine the need for other types of expert examinations, or offer recommendations for conducting procedural actions aimed at detecting, seizing, and examining items and documents with characteristics of material evidence.
