Essay

The thesis covers the study of the criminological characteristics of torture, as well as the determinants of the formation of the identity of the offender who commits such a crime and the problems of its prevention. Within the framework of the dissertation, scientific and theoretical results were obtained, which are of importance not only for science but also for the activity of law enforcement agencies. The thesis provides a thorough analysis of international and legal regulations that protect citizens from torture and cruel, inhuman or what degrading treatment or punishment (general, protecting human and civil rights in various areas, and the special, which protect people from use of torture). It has been argued that the victim should be defined as a person or a certain set of people in any form of their integration, who directly or indirectly inflicted physical, moral or material harm on a crime, regardless of whether the person recognizes himself as a victim in accordance with the established procedure and whether he considers himself such. Victimology prevention warns a person that he or she may be a victim of torture because of his or her behavior, which must be changed in order not to risk it. Victimological prevention aims to limit the risk of becoming a victim of torture, it teaches people on the need to protect themselves from these attacks, prevention warns that people should learn not from their mistakes but the mistakes of those who have already become a victim of torture. Much depends on their behavior, the ability to properly navigate a criminal situation. The main thing in preventing victim behavior is to prevent a situation in which a person may become a victim of torture.
