Dissertation for obtaining the degree of Doctor of Philosophy in specialty 081 - "Law". – National Academy of Internal Affairs, Kyiv, 2024. The dissertation is one of the first comprehensive monographic studies in which a praxeological approach to the formation of criminological principles for the prevention of violent crimes committed by marginal groups is implemented, with the determination of ways to solve a number of fundamental and applied problems in the activities of police bodies and the public. The periodization of criminological studies of the problems of marginality and marginalization of the population in Ukraine has been carried out, with the division into the following stages: initial - the study of marginalization processes of the population as a cultural phenomenon, the study of the phenomenon of the marginal person, the basis of the study - cultural conflict (end of the 19th - beginning of the 20th century); intermediate - the development of the idea of marginality in the context of the movement of citizens from one social group to another, practical studies in the works of representatives of urban sociology of the American and Western European criminological scientific schools (1920 - 1991); modern - providing a criminological characterization of marginality in Ukraine, researching the marginal person, establishing the causes and conditions of marginalization of the population (1991 - up to date). A multi-functional approach to: a) marginality: lack of regulatory regulation of the legal position of a marginalized person; exclusion or refusal of a person from maintaining social relations and connections (desocialization of a person); deformation of the person, which is associated with a negative, conflicting attitude towards social cultures and values. The main characteristics of this phenomenon are: lack of regulatory regulation of the legal status of a marginalized person; exclusion or refusal of a person from maintaining social relations and connections (desocialization of a person); deformation of the person, which is associated with a negative, conflicting attitude towards social cultures and values; b) marginal behavior as a type of lawful behavior that is determined by objective reality and intrapersonal conflict, a low level of legal culture and consciousness of the person, is expressed in neglect of universal human values and interests, takes into account only personal needs, is aimed at fulfilling legal prohibitions and obligations through reluctance to bear responsibility, but due to deterministic processes, leads to the commission of criminal offenses, including violent crimes; c) marginal violent behavior, in which the lifestyle of socially disadvantaged groups of the population, alienated from socially useful ties, usually without a permanent source of income, characterized by delinquent behavior and therefore prone to committing criminal offenses, is recognized as marginal, in that among violent crimes, and marginal violent crime is a set of violent crimes (a deliberate criminal act manifested in the application of physical and psychological influence on the organs, tissues, psyche of the victim or the threat of its application), committed by persons leading a marginal lifestyle ; d) composition of marginal behavior (object, objective side, subject, and subjective side) as informational and cognitive in the process of interaction of legality and illegality, as well as a toolkit of criminological monitoring with the help of which an assessment of human behavior, choice and application of optimal effective preventive measures with the division of such behavior into positive and negative; individual, group; voluntary, forced; social, economic, political; active, passive, ordinary, socially approved; personal-oriented, selfish-oriented; e) aggression as physical or psychological behavior of a person, aimed at the violent destruction of universal human values and ideals and is manifested in criminal offenses of a violent nature (criminal aggression), in particular: actions of a destructive nature, a means of causing legitimate violence (natural aggression) and illegal violence ( social aggression) in order to achieve a certain goal, to realize the motivational sphere.
