The dissertation is devoted to the study of specific approaches to protecting the right to life of an employee in the course of work. The research and analysis of the general theoretical issues of the right to life, the right to work, and their dialectical interrelation are revealed. It is argued that the right to life of an employee as a person and personality is his fundamental right, the primary basis of all other rights, the realization and protection of which are exercised through the realization and protection of other natural rights.
It is noted that the protection of the right to life of an employee in the sphere of work is realized by protecting the labor rights of employees in different types of labor relations: in the sphere of employment, pay, working and rest time, disciplinary and material responsibility, labor protection, etc. This is because the fundamental labor rights of workers are inextricably linked to the right to work. The right to work is derived from the right to life. In fact, labor rights are indirectly (through the right to work) derived from the right to life, since they are aimed at ensuring the latter fully. In this regard, protecting the right to life of an employee in the workplace will have common features with the protection of the employee's labor rights.
It is substantiated that life is not just an existence, but a constant development of a person in the process of work as an individual, a member of society. That is why the mechanism of its protection must always be functioning, acting in the process, not only during or after the violation of these rights. Accordingly, protecting the right to life of an employee in the workplace includes a system of means, ways not only to eliminate and terminate, but also to prevent various factors that may adversely affect the life and health
of the employee in the course of work.
It is noted that at the legislative level it is necessary to consolidate the concept of «decent standard of living» with the indication of the categories that determine its level. A decent standard of living should be conditioned not only by the reproduction of the employee's life as a consumer of material goods, but also by the creation of conditions for the full realization of his or her personality, the development of his / her professional and creative potential in the process of work. It is emphasized that a decent standard of living depends first and foremost on the economic level of development of the state and society, which is one of the conditions for its formation as a social state. Therefore, any draft national programs should be implemented through means such as social function and social policy of the state. An indispensable part of a decent life is decent work, which must include, above all, adequate remuneration, which should act as an indicator, a major factor in the formation of a decent standard of living, which in turn will create the right conditions for the full realization of the employee as a person.
