The thesis incorporates a theoretical generalization and a novel solution for a scientific problem that consists in substantiation of criminal liability for avoidance of conscription for active military service, compulsory military service for officers, creation of an enhanced framework for Article 355 of the Criminal Code of Ukraine (hereinafter – the CCU) and elaboration of proposals with regard to the improvement of legislative provisions and practices of their application. It has been proven that the actions related to evasion of medical examination (as a stage of conscription) fall under the definition of the elements of crime under Article 355 of the CCU.
