Essay

The object of the study is the public relations that arise in the process of appointment, conduct and evaluation of the results of forensic construction and technical expertise. The purpose of the study is to determine the content and features of organizational and legal, general and methodological principles of forensic construction and technical expertise as a source of evidence in the investigation of crimes in the field of construction, as well as solving problems in this area. The methodological basis of the dissertation research was a systematic approach, due to the specifics of the topic and associated with the use of general, individual and special methods: historical, formal-logical, statistical and comparative-legal methods, as well as methods of analysis and synthesis. Theoretical and practical results, novelty: on the basis of the analysis of scientific works on development of concept of a subject of forensic examination and own scientific search the author's definition of a subject of forensic construction and technical examination is developed and the range of tasks of this kind of examination is allocated; the range of tasks of forensic construction and technical experts is singled out, from the point of view of its significance as a source of evidence; the methodological basis of forensic construction and technical examination through the study of the systematics of forensic examination in general and forensic construction and technical examination in particular is determined; the peculiarities of the content of the expert opinion based on the results of forensic construction and technical research are revealed; the directions and criteria for evaluating the conclusion of the forensic construction and technical examination are determined. Degree of implementation: in scientific activity as a basis for further research of problems of development of theoretical, scientific-methodical and normative-legal questions of forensic examination, including complex; in law-making activity - for use during improvement of norms of the current legislation (laws and other normative legal acts); in the educational and methodological sphere - in the teaching of courses of criminology and forensic science, criminal proceedings, in the preparation of relevant textbooks and manuals, in the process of training experts. Scope: in expert work - as a methodological basis for forensic construction and technical examinations.
