Hryhorova Y. Investigation bribery of voter, referendum participant

This dissertation is the first in Ukraine research of theoretical bases and practical questions of a technique of investigation of bribery of the voter, the participant of a referendum. The paper formulates and substantiates a number of new provisions and conclusions that are important for forensic science, investigative and judicial practice. The most significant complications that arise in the practice of law enforcement authorities during the investigation of bribery of a voter, referendum participant are identified and taken into account when determining the objectives of the dissertation. Found the place of the criminals provided by Art. 160 of the Criminal Code of Ukraine, in the system of criminal offenses against the voting rights of citizens. Covered the state of scientific researches of problems of investigation of bribery of the voter, the participant of a referendum in works of domestic and foreign scientists. It was found that the method of investigating the bribery of a voter, a referendum participant in some parts is analogous to the method of investigating other types of electoral criminal offenses, as well as the method of investigating the receipt of illegal benefits (bribes) in general. The current state of methodological support for the investigation of these crimes is studied and a conclusion is made on the need for its significant addition and improvement, especially given the amendments to Art. 160 of the Criminal Code of Ukraine, which also affected the procedural rights of the investigator in such proceedings.
