Essay

The thesis studies the essence and specificities of the administrative and legal framework for investigation in respect of administrative offences by the National Police, as well as makes proposals and recommendations, aimed at improving corresponding administrative legislation. It is proven that the legal nature of proceedings for administrative offences, as currently understood, has arisen at the beginning of the last century. It is noted that by the end of the 1970s and early 1980s the development process has been rather slow, without adequate legal and regulatory support for such processes. It is only with the adoption of the CAO of Ukraine that the normative regulation of these social relations has been enshrined, enhancing its effectiveness. Since Ukraine’s independence, related legal institutions have been developing, and they also have an impact on the legal nature of administrative offences. It is argued that the structure of proceedings in respect of administrative offences can be defined as the totality of its substantive components and the means of their connection. In such a case, the structural elements of the proceedings can be determined from, at least, two perspectives, depending on the perception of the nature of the proceedings in administrative offences.
