Smorodyna A. License agreement in the civil law of Ukraine

The dissertation is the first complex research of the theoretical and practical issues of the legal regulation of the license agreement as a type of agreement on disposal of intellectual property rights (the “IPR”) in civil law of Ukraine. The characteristics of the license agreement as a civil law agreement, its essential terms and specifics of its conclusion on the use of different IPR objects are researched. The paper provides a thorough study of regulations on intellectual property law (on copyright, inventions and trademarks) to follow the formation and development of the licensing agreement in the laws of Ukraine. The normative legal acts of the Russian Empire, in which the legal regulations of the disposal of IPR objects are introduced based on the understanding of the right of ownership over them, are defined. The normative legal acts adopted in the USSR and the Ukrainian SSR are determined.
