Alimenko O. Implementation of representation by a lawyer when considering inheritance cases with a foreign element by a court

The thesis is the first comprehensive study of theoretical and practical issues of representation by a lawyer when considering inheritance cases with a foreign element by a court. To expand on the topic of the thesis research, the author used the provisions of the Constitution of Ukraine, international multilateral statutory legal acts and bilateral agreements on legal assistance in civil and criminal matters, laws and bylaws of Ukraine, decisions of the Constitutional Court of Ukraine, the Supreme Court of Ukraine, the Supreme Court and other courts of general jurisdiction, decisions, reports and other information materials of governmental and non-governmental organizations, legislative acts of foreign states and international intergovernmental organizations. The paper analyzes and provides the author's definition of the concepts of “inheritance cases with a foreign element” and “representation in inheritance cases with a foreign element”. The thesis candidate has studied the legal categories “legal assistance”, “professional legal assistance”, and “representation” in a systematic relationship.
