The dissertation explores the theoretical foundations of proving the subjectivity of the party through forensic examinations in the investigation of categories of offenses related to life and health, encroachment on honor and dignity, as well as sexual freedom and inviolability, and summarizes domestic and foreign experience on this issue. The analysis of the concepts of guilt and innocence in the criminal process provided an opportunity to identify the main features that need to be established during the pre-trial investigation in the evidentiary process.
