SHRAMKO O. Use of special knowledge in the investigation of corruption offenses

The dissertation develops theoretical provisions and scientifically substantiated recommendations for using of special knowledge in the investigation of corruption offenses. It is established that the research of special knowledge using in criminal proceedings was carried out in the following aspects: the use of special knowledge in the investigation of certain types of criminal offenses, in particular in the fields of economics, public authorities; commissioning and conducting of certain types of forensic examinations; specialists involvement for their participation in investigative (search) activities; general scientific and theoretical bases of special knowledge using in criminal proceeding. The vast majority of scientific papers on the use of special knowledge in the investigation of criminal offenses, including corruption, had been completed before 2012 when the Criminal Procedure Code of Ukraine applied. Some aspects of special knowledge using in the investigation of corruption offenses by domestic scientists were considered in the study of: a) methodology of investigating the unlawful benefits obtaining by an official; the abuse of power or official position – in the form of forensic examinations and specialists involvement in investigative (search) activities; b) peculiarities of crimes investigation in the field of narcotic drugs, psychotropic substances, their analogues or precursors trafficking; economic crimes, including ones in the field of agricultural production, construction, theft of property through abuse of official position; illicit enrichment; c) procedure of special knowledge using in criminal proceedings (specialist involvement in criminal proceedings by a prosecutor under the Article 368 of Criminal Code of Ukraine, specialist participation in evidence gathering for forensic evidence, etc.); d) certain types of special knowledge used in the investigation of criminal offenses (special economic, accounting, commodity knowledge).
