Hvozdiuk V. Тactical aspects of investigative (search) activities performance guided by ECHR practices

Thesis presents formulation of theoretical provisions and proposals to amend the criminal procedure legislation, set of forensic recommendations regarding the tactics of investigative (search) actions guided by the practices of the European Court of Human Rights. Based on the results of research and the context of ECHR practices the following tasks have been acomplished: the genesis of investigative (search) tactics is outlined; the research dynamics for problems of investigative (search) tactics is analyzed; the regulatory framework of investigative (search) tactics is identified; the tactical aspects of examination, interrogation and search activities are characterized; possible options to improve the tactics of investigative (search) actions performance with aim to ensure the rights and freedoms of criminal proceedings parties are outlined; ways to optimize the tactics of investigative (search) actions performance upon condition of special knowledge application are defined; ways to harmonize the tactics of investigative (search) actions performance with European standards are proposed.
