The dissertation is a complex scientific study devoted to the improvement of the theoretical and practical administrative and legal principles of responsibility of foreigners and stateless persons. The relevance of the research topic is due to the need to implement the recommendations of the European Commission regarding the status of Ukraine for EU membership, Ukraine's joining the European Migration Network as an observer, and the implementation of the State Migration Policy Strategy of Ukraine until 2025. As a result of the conducted research, a systematic analysis of the achievements of domestic and foreign jurisprudence, the current legislation of Ukraine and foreign countries, EU law regarding the administrative and legal bases of responsibility of foreigners and stateless persons, the scientific task of improving the mechanism of bringing such persons to justice was solved, certain theoretical conclusions were formulated and a number of proposals were made to the national legislation in the researched area. Based on the analysis of scientific approaches to the structure and elements of the legal status of a person in general, foreigners, stateless persons in particular, it was determined that the legal status of foreigners and stateless persons is the legally established status of these persons in society, conditioned as general (rights, duties, guarantees, legal liability), and special (legal regime applicable to foreigners and stateless persons in Ukraine) components. The expediency of including in the structure of the legal status of foreigners and stateless persons such an element as the legal regime (a set of legal means and methods used in the field of realization of the rights of foreigners and stateless persons and their performance of duties, and providing favorable conditions for the implementation of migration policy by the state) is argued ). Distinguishing features between the rights of foreigners, stateless persons and the rights of refugees are defined. The relationship between the subjective rights and legal obligations of foreigners and stateless persons is studied. Based on the analysis of the place and significance of legal guarantees as elements of the legal status of foreigners and stateless persons, their classification into international, constitutional and branch is proposed. Based on the analysis of three main approaches to the definition of the concept of "legal responsibility", namely retrospective, positive and multi-aspect, a definition of "administrative responsibility of foreigners and stateless persons" is proposed as a legal institution based on specific prescriptions of administrative law, having a regulatory and/or or protective content and is expressed in the observance of legal rules of behavior by foreigners and stateless persons in the context of preventing their violation or applying reasonable coercion to offenders (that is, the occurrence of negative consequences for a person for violating the norms of administrative law). The expediency of improving the institution of administrative responsibility of foreigners and stateless persons by implementing European standards, taking into account the national social order, peculiarities of the cultural and historical development of Ukrainian society, is argued. It was emphasized that one of the directions for improving the administrative responsibility of foreigners and stateless persons is the regulatory separation of administrative and criminal offenses in this area, since according to the provisions of the Criminal Code of Ukraine, criminal offenses are divided into misdemeanors and crimes. One of the ways to improve the criminal and administrative tort law is the unification of criminal offenses and administrative offenses in a separate codified legal act or the decriminalization of all criminal offenses. It is proposed to streamline the system of administrative penalties that can be applied to foreigners and stateless persons by setting out part 3 of Article 24 of the Code of Ukraine on Administrative Offenses in the following wording: «Administrative penalties that can be applied to foreigners and stateless persons, except for those set out in part 1 of this of the article, there is administrative deportation outside Ukraine, return to the former place of residence, reduction of the period of stay for committing administrative offenses that grossly violate law and order».
