The dissertation is aimed at the complex solution of scientific and practical tasks and research of protection and defense of corporate rights by a notary under the civil legislation of Ukraine.
The dissertation is the first comprehensive study in which a detailed scientific and theoretical analysis of the protection and defense of corporate rights by a notary under the civil law of Ukraine has beem made and on its basis there have been developed recommendations and proposals in order to improve regulations in this area of private relations.
The Section 1 «General theoretical characteristics of protection and protection of corporate rights by a notary under the civil law of Ukraine» has explored the concept of protection and defense of corporate rights by a notary, and has clarified the system of corporate rights that may be the subject to notarial protection and defense.
The Section 2 «Notarial protection of corporate rights» has been devoted to the analysis of the legal regulation of notarial protection of corporate rights of individuals, of legal entities and of the other participants in civil turnover.
The Section 3 «Civil legal defense of corporate rights by a notary» has described the methods of notarial protection of corporate rights and their types. In addition, the features of the notary's writ of execution as a way to defend corporate rights have been studied.
The formulated conclusions, proposals and recommendations in the study can be used for general theoretical work and improvement of law in the field of protection and defense of corporate rights, they can be used in research, practical and legislative activities, as well as in the educational process, including teaching, such disciplines as «Civil Law of Ukraine», «Economic Law of Ukraine», «Corporate Law», «Notarial Law of Ukraine», «Notarial process» «Problems of the notarial process», etc.).
